EverPawCraft provides this website, including the information, products, customization services, artwork preview services, tools, and other features available through the website, subject to your acceptance of these Terms & Conditions.

By visiting our website, placing an order, submitting photographs or other materials, communicating with us about an order, or otherwise using our services, you agree to be bound by these Terms & Conditions, together with any additional policies referenced on the website, including our:

· Privacy Policy;

· Shipping Policy;

· Returns & Refund Policy; and

· any product-specific instructions or terms displayed before checkout.

Please read these Terms & Conditions carefully before accessing or using the website. If you do not agree with them, you should not use the website or purchase our products.

Our online store is hosted by Shopify, which provides the ecommerce platform through which we offer our products and services.

2. Eligibility and Online Store Use

By using this website, you confirm that you are at least the age of majority in your country, state, or province of residence, or that you are using the website with the permission and supervision of a parent or legal guardian.

You may not use the website, our products, or our services:

· for any unlawful or unauthorized purpose;

· in violation of any applicable law or regulation;

EverPawCraft creates personalized pet artwork, keepsakes, decorative products, gifts, memorial products, and other made-to-order items.

Because our products are customized using customer-provided photographs, videos, names, descriptions, and design instructions, each finished product may vary slightly from:

· product-page examples;

· digital mockups;

· artwork previews;

· photographs displayed on different devices; and

· previously completed customer products.

Product photographs and examples are provided to illustrate the general style, composition, format, and expected appearance of our work. They do not guarantee that every handmade, printed, framed, embroidered, sculpted, or otherwise produced item will be identical.

We reserve the right to:

· modify or discontinue products;

· update product descriptions;

· change available styles, sizes, materials, or options;

· limit quantities;

· decline requests that cannot reasonably be produced;

· restrict sales to particular regions; and

· refuse orders that violate these Terms or applicable law.

Nothing in these Terms excludes any statutory rights that cannot lawfully be excluded.

4. Personalized and Made-to-Order Products

Most EverPawCraft products are created specifically for an individual customer and may contain a customer’s selected:

· pet photograph or video;

· pet name;

· written message;

· memorial date;

· colors;

· design style;

· background;

· clothing or accessories;

· size;

· layout; or

· other personalized details.

You are responsible for reviewing all customization information before submitting an order.

We are not responsible for errors in the finished product that result directly from inaccurate information supplied by you, including:

· misspelled names;

· incorrect dates;

· incorrect wording;

· incorrect addresses;

· unclear instructions;

· low-quality reference photographs; or

· approval of an artwork preview containing the relevant error.

Where we identify an obvious issue before production, we may contact you for clarification, but we are not obligated to independently verify every name, date, spelling, or instruction.

5. Customer Photographs and Reference Materials

To create a personalized product, you may be asked to provide photographs, videos, drawings, text, pet descriptions, design instructions, memorial details, or other reference materials.

By submitting materials to EverPawCraft, you confirm that:

1. you own the materials or have the necessary permission to use and submit them;

2. our use of the materials to fulfill your order will not infringe another person’s copyright, trademark, privacy, publicity, contractual, or other rights;

3. the materials do not contain unlawful, abusive, defamatory, obscene, or harmful content; and

4. you have obtained appropriate permission before submitting identifiable images of another person.

You retain any ownership rights you have in your original photographs, videos, text, and other materials.

You grant EverPawCraft a limited, non-exclusive, worldwide, royalty-free license to use, copy, crop, edit, adapt, transmit, and share those materials only as reasonably necessary to:

· review and process your order;

· create artwork previews;

· make requested revisions;

· produce and manufacture your personalized product;

· communicate with you;

· conduct quality control;

· provide replacements or approved reorders; and

· maintain reasonable order and dispute records.

This limited license may also extend to artists, designers, manufacturers, fulfillment providers, cloud-storage providers, and other service providers assisting with your order.

Submitting materials for order fulfillment does not, by itself, give EverPawCraft unrestricted permission to use those materials publicly for advertising.

We may request your separate permission before using original customer photographs, stories, reviews, completed artwork, or finished products in public-facing marketing, except where another clearly disclosed content-release agreement applies.

6. Image Quality and Reference Requirements

The quality and accuracy of personalized artwork depend substantially on the reference materials you provide.

For the best result, photographs should generally be:

· clear and in focus;

· well lit;

· sufficiently high resolution;

· taken without strong filters;

· unobstructed;

· representative of the pet’s natural coloring and features; and

· suitable for the selected product style.

We may request additional photographs or videos if the original materials are unclear, incomplete, heavily filtered, cropped, dark, blurry, or otherwise unsuitable.

If you ask us to proceed using materials that we have identified as limited or unsuitable, the final result may reflect those limitations.

Creative interpretation is part of personalized artwork. Features such as expression, pose, fur texture, color, lighting, proportions, and background may be artistically adapted to suit the selected design.

7. Artwork Preview Process

Where an artwork preview is included with a product, we will send the preview using the contact information provided with your order.

Email is our primary communication method. Where you voluntarily provide a WhatsApp number, we may also use WhatsApp for preview reminders, clarification requests, revision communications, and order updates.

You are responsible for:

· providing an accurate email address and telephone number;

· checking your inbox and spam or junk folders;

· reviewing previews promptly;

· clearly communicating requested revisions; and

· confirming approval when satisfied.

Production may not begin until required approval is received.

Any estimated production or delivery period may be extended if:

· you do not respond;

· additional photographs are required;

· instructions are incomplete;

· multiple revisions are requested;

· requested changes materially alter the original design; or

· approval is delayed.

Revision Requests

The number and scope of included revisions may depend on the product description or offer displayed when you order.

Included revisions are intended to correct or refine the agreed design. They do not necessarily include:

· changing to an entirely different artwork style;

· replacing the pet or principal subject;

· changing the selected product;

· creating multiple alternative compositions;

· restarting the artwork after substantial work has been completed; or

· making changes after final approval or production has begun.

Major changes may require an additional fee or a new order. We will inform you before applying an additional charge.

8. Artwork Approval

When you approve an artwork preview, you confirm that you have reviewed and accepted the visible:

· pet appearance;

· spelling;

· dates;

· wording;

· colors;

· layout;

· background;

· composition; and

· customization details.

Once a preview has been approved, the order may immediately enter production. Changes, cancellations, or refunds may no longer be possible after that point.

If you do not respond within the period stated in our preview communication, we may:

· send reasonable reminders;

· place the order on hold;

· delay production;

· proceed under a clearly disclosed automatic-approval rule, but only where that rule was communicated before or during the preview process; or

· cancel the order where completion has become impracticable.

We will not apply an automatic-approval rule unless the relevant timeframe and consequences have been clearly communicated to you.

Minor differences may occur between a digital preview and the physical product due to printing, embroidery, carving, manufacturing, screen calibration, material texture, lighting, and other production factors.

9. Orders and Order Acceptance

Submitting an order does not guarantee acceptance.

An order is accepted when we confirm it or begin performing the customization service, whichever occurs first.

We may refuse, limit, place on hold, or cancel an order where:

· payment cannot be authorized;

· information is inaccurate or incomplete;

· fraud or unauthorized activity is suspected;

· the requested content violates law or third-party rights;

· the customization cannot reasonably be produced;

· the product is unavailable;

· a pricing or listing error occurred;

· the delivery destination is unsupported; or

· the order appears to be placed for unauthorized resale or commercial reproduction.

If we cancel an order before providing the relevant product or service, we will issue any refund required under our Returns & Refund Policy and applicable law.

We may limit purchases made using the same customer account, payment method, billing address, shipping address, household, or other identifying information.

10. Prices and Payments

Prices are displayed in the currency shown on the website or at checkout.

Prices may change without prior notice, but changes will not normally affect an order already accepted, except where:

· there is an obvious pricing error;

· taxes, duties, or mandatory charges apply;

· you request additional customization; or

· the order is modified with your agreement.

Payment is processed through third-party payment providers available at checkout. By submitting payment information, you confirm that:

· the information is accurate;

· you are authorized to use the payment method;

· sufficient funds or credit are available; and

· the payment provider may process the transaction under its own terms.

We generally do not directly store complete credit or debit card numbers.

You are responsible for any charges imposed by your bank, card issuer, payment provider, or currency-conversion service.

11. Taxes, Customs, and Import Charges

Applicable taxes may be calculated and displayed at checkout.

International orders may be subject to:

· import duties;

· customs charges;

· brokerage fees;

· value-added tax;

· goods and services tax; or

· other government charges.

Unless expressly stated otherwise at checkout, these charges are not included in the product or shipping price and may be payable by the recipient.

Customs procedures may delay delivery. We are not responsible for delays caused by customs authorities or for charges lawfully imposed by the destination country.

Where applicable law requires us to collect and remit particular taxes or duties, we will do so through the checkout process or relevant sales channel.

12. Cancellations

Because personalized orders may involve immediate artistic and administrative work, cancellation rights depend on the stage of the order.

A cancellation request should be sent to legal@everpawcraft.com as soon as possible.

A cancellation may be available before:

· artwork creation has begun;

· an artist has been assigned;

· a preview has been prepared;

· materials have been ordered;

· manufacturing has started; or

· other non-recoverable costs have been incurred.

Once customization work or production has begun, the order may not be cancellable, or reasonable costs already incurred may be deducted from any refund, where permitted by law.

An order cannot normally be cancelled after final artwork approval or the start of physical production.

Nothing in this section limits cancellation rights that cannot lawfully be excluded.

13. Returns, Refunds, and Replacements

Returns, refunds, replacements, and cancellations are governed by our Returns & Refund Policy, which forms part of these Terms.

Because personalized products are made according to customer specifications, they generally cannot be returned or refunded merely because:

· the customer changed their mind;

· the product is no longer wanted;

· the customer selected the wrong option;

· the customer supplied incorrect information;

· the customer approved the artwork; or

· the finished product contains ordinary differences inherent in the production process.

This does not affect rights relating to products that are:

· defective;

· damaged in transit;

· materially different from the approved artwork or order;

· not as described; or

· otherwise non-conforming under applicable consumer law.

You should inspect your order after delivery and contact us within the timeframe specified in our Returns & Refund Policy if there is a problem.

We may request photographs, packaging images, shipping labels, or other evidence needed to assess a claim.

Do not return a product without first contacting us and receiving return instructions.

14. Production and Shipping

Processing and shipping estimates are provided in the applicable product description, Shipping Policy, checkout, order confirmation, or customer-service communication.

Processing time and shipping time are separate.

Estimated delivery dates are not guaranteed unless expressly stated otherwise. Delays may arise from:

· artwork revisions or delayed approval;

· production capacity;

· material availability;

· quality-control issues;

· shipping-carrier disruption;

· customs procedures;

· severe weather;

· public holidays;

· incorrect addresses;

· events outside our reasonable control; or

· other operational circumstances.

We will take reasonable steps to communicate material delays.

Some products may be produced or shipped by third-party artists, manufacturers, printers, craftspeople, or fulfillment partners and may ship from different locations.

Orders containing multiple items may arrive in separate packages.

15. Shipping Addresses and Delivery

You are responsible for providing a complete and accurate shipping address.

Please contact us promptly if an address needs to be changed. We cannot guarantee that an address can be changed after production, fulfillment, or shipment has begun.

We are not responsible for delivery problems caused by:

· an incorrect or incomplete address provided by the customer;

· refusal to accept delivery;

· failure to collect a package;

· failure to pay applicable customs charges;

· unauthorized redirection requested by the recipient; or

· circumstances outside our reasonable control.

Where a shipment is returned to us, additional shipping or handling charges may apply before it can be resent.

Risk of loss and legal title will pass in accordance with applicable law and the delivery terms presented at checkout.

16. Product Appearance and Color Differences

We make reasonable efforts to display product photographs, artwork examples, colors, dimensions, and materials accurately.

However, we cannot guarantee that:

· a device screen displays colors accurately;

· printed colors exactly match digital previews;

· natural materials are completely uniform;

· handmade details are identical between products;

· embroidery reproduces every fine photographic detail;

· framing, cropping, or scaling appears identical across sizes; or

· lighting conditions will not affect the perceived appearance.

Small differences resulting from screen settings, materials, manufacturing methods, printing, embroidery, carving, hand-finishing, or artistic interpretation are not necessarily defects.

Product measurements may also vary slightly within reasonable manufacturing tolerances.

17. Personal Use and Commercial Use

Unless we agree otherwise in writing, EverPawCraft products and personalized designs are sold for personal, household, decorative, memorial, or gift use.

Purchasing a physical product does not automatically transfer copyright or commercial reproduction rights in:

· the artwork;

· design;

· layout;

· illustration style;

· digital preview;

· production file; or

· other creative work created by EverPawCraft or its artists.

You may not, without prior written permission:

· reproduce the design for resale;

· manufacture additional products using the design;

· sell digital copies;

· license the artwork to another business;

· use the artwork as a business logo or trademark;

· use it in commercial advertising;

· mint or sell it as an NFT or comparable digital asset; or

· remove ownership or copyright notices.

A separate commercial license may be available by written agreement.

18. EverPawCraft Intellectual Property

Except for customer-owned materials and third-party content, the website and its content are owned by or licensed to EverPawCraft.

Protected content may include:

· brand names;

· logos;

· artwork examples;

· illustrations;

· photographs;

· videos;

· product designs;

· text;

· graphics;

· icons;

· layouts;

· software;

· customization workflows; and

· website presentation.

You may access and use the website for personal shopping purposes only.

You may not copy, reproduce, republish, upload, post, transmit, distribute, modify, sell, license, reverse engineer, or commercially exploit protected content without prior written permission.

No rights are granted except those expressly stated in these Terms.

19. Reviews, Feedback, and Other Submissions

You may choose to submit reviews, comments, suggestions, testimonials, or other feedback.

You confirm that your submission:

· is accurate and reflects your genuine experience;

· does not infringe another person’s rights;

· is not defamatory, deceptive, unlawful, obscene, or abusive;

· does not contain confidential information;

· does not contain malware or harmful code; and

· does not impersonate another person.

You retain ownership of your review or feedback.

By submitting it for publication, you grant EverPawCraft a non-exclusive, worldwide, royalty-free license to display, reproduce, format, translate, and distribute it in connection with our website, customer service, and marketing.

Where a review includes a customer photograph, identifiable person, pet story, or completed personalized artwork, we may request separate permission before using it outside the context in which it was originally submitted.

We may remove or decline to publish content that violates these Terms, but we are not obligated to monitor every submission.

20. Privacy

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy.

By using the website, you acknowledge that information may be processed by Shopify and by service providers assisting with payment, artwork creation, manufacturing, communications, analytics, fulfillment, and shipping.

21. Third-Party Services and Links

The website may contain links to third-party websites or use third-party services, including payment services, Shopify applications, social media platforms, analytics tools, and communication providers.

Third-party services may be governed by separate terms and privacy policies.

We do not control and are not responsible for the availability, content, security, accuracy, products, or practices of independent third parties.

Your use of a third-party service is at your discretion and subject to that provider’s terms.

This provision does not exclude responsibility that cannot lawfully be excluded.

22. Errors and Inaccuracies

Occasionally, the website may contain typographical errors, inaccuracies, or omissions relating to:

· customization options;

· shipping charges;

· processing times;

· delivery estimates; or

· availability.

We may correct errors, update information, or cancel an affected order where reasonably necessary.

Where an obvious pricing or listing error affects an order, we may contact you to offer the correct terms or cancel and refund the affected order.

We are not required to honor an obvious error where doing so would be unlawful, unreasonable, or commercially impracticable.

23. Prohibited Content and Customization Requests

We may refuse to create or reproduce content that:

· infringes copyright, trademark, privacy, publicity, or other rights;

· contains hate speech or unlawful discrimination;

· promotes violence, abuse, or criminal activity;

· contains explicit sexual content;

· exploits or endangers children;

· involves animal cruelty;

· violates applicable law; or

· is otherwise reasonably considered harmful or inappropriate.

Refusal of a customization request does not imply any judgment regarding the customer personally.

Where possible, we may offer an alternative design. If no acceptable alternative is available, we may cancel and refund the unfulfilled portion of the order.

24. Availability of the Website

We do not guarantee that the website will always be available, uninterrupted, secure, or error-free.

We may temporarily suspend, update, modify, or discontinue parts of the website for:

· maintenance;

· security;

· technical changes;

· service-provider changes;

· legal compliance; or

· operational reasons.

We are not responsible for temporary unavailability outside our reasonable control.

25. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and its online features are provided on an “as available” basis.

To the fullest extent permitted by applicable law, EverPawCraft will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of the website or products where such losses were not reasonably foreseeable.

We are not responsible for losses caused by:

· inaccurate information supplied by the customer;

· unauthorized submission of third-party content;

· failure to review an artwork preview;

· approval of an incorrect design;

· misuse of a product;

· third-party websites or services;

· customs procedures;

· shipping-carrier events outside our reasonable control; or

· events beyond our reasonable control.

Where liability may lawfully be limited, our aggregate liability relating to an order will generally not exceed the amount paid for the product giving rise to the claim.

This limitation does not reduce any mandatory consumer remedies.

27. Customer Responsibility for Third-Party Claims

You are responsible for claims arising directly from materials you submit where:

· you did not own or have permission to use them;

· they infringed another person’s intellectual property, privacy, or publicity rights;

· they contained unlawful content; or

· your statements regarding ownership or permission were materially false.

To the extent permitted by law, you agree to reimburse EverPawCraft for reasonable losses, costs, or liabilities directly resulting from such a breach.

This section does not apply to losses caused by EverPawCraft’s own unauthorized use of your materials.

28. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including:

· natural disasters;

· severe weather;

· fire or flood;

· epidemic or public-health emergency;

· war, terrorism, or civil disturbance;

· labor disputes;

· transportation disruption;

· customs delays;

· power or internet failure;

· governmental action;

· supplier interruption; or

· carrier failure.

We will take reasonable steps to reduce the effect of such events and resume performance when practicable.

29. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be limited or removed only to the minimum extent necessary.

The remaining provisions will continue in effect.

Nothing in this section excludes representations or rights that cannot lawfully be excluded.

Because EverPawCraft has not represented itself as a company established in the United States or United Kingdom, these Terms do not designate a fictitious US or UK company, registered address, or exclusive court jurisdiction.

These Terms remain effective while you use the website or have an active order.

You may stop using the website at any time.

We may suspend or terminate access where we reasonably believe that you:

· violated these Terms;

· engaged in fraud or unlawful conduct;

· interfered with the website;

· abused staff, artists, partners, or other users; or

· created a material security or legal risk.

Termination will not affect obligations, payments, rights, licenses, or liabilities that arose before termination or that are intended to continue afterward.
